1. Inclusion of the General Terms and Conditions
The following conditions apply to all contracts concluded in connection with the tennis school PRO TENNIS PETRATSCHEK (hereinafter “tennis school”). Subsidiary agreements, changes or additions must be made in writing.

2. Conclusion and duration of the contract
By submitting your registration, you are making an offer to the tennis school to conclude a service contract. The tennis school is free to accept this offer. The general terms and conditions are deemed to be accepted as soon as the contract is concluded. The contract is valid for the advertised training period and cannot be terminated early. In the event of early termination of the contract, the full invoice amount must be paid. Amounts already paid will not be refunded. The general terms and conditions of the tennis school and the court and hall regulations of the TC Rot-Blau Regensburg eV are binding for all training participants.

3. Training
Our range of services includes team, group and individual training. The tennis school’s trainers divide the groups according to practical requirements, in particular according to playing ability and age. The division can be changed if necessary.
The tennis school reserves the right to assign the trainers. If this is necessary for organizational reasons, the tennis school is entitled to change trainers or give replacement lessons during the season.
The wishes of our customers are taken into account as far as possible. If courses are not fully booked, group changes can be made, which require further coordination. Such a change does not entitle the customer to terminate the contract.
The tennis school is entitled to accept additional course participants into a group on an individual basis for a “trial training session”. This requires prior coordination with the group members. The changed costs for the lessons will be reimbursed by the new student to the original group members.

4. Training

A training session lasts 30, 60, 90 or 120 minutes. The necessary court maintenance and warm-up also take place during this time. Training sessions may only be completed in sports clothing and tennis shoes. The tennis courts in the tennis halls may only be entered with suitable indoor shoes. Any illnesses or health restrictions must be expressly reported to the tennis school trainer before training begins. Sweets of any kind are prohibited during training. Glasses and unsealable bottles are not permitted in the hall. The trainer’s instructions must be followed at all times.

5 a. Training costs
The training costs are paid by transferring the invoice sent to you, by direct debit or by purchasing in our online shop. The agreed total prices are always binding. This total price includes the VAT applicable at the time the contract is concluded and the training material.

5 b. Hall costs
For the use of the hall in connection with tennis training at the tennis school, hall usage fees apply, which are invoiced by the tennis school.

6. Missed lessons

Missed hours during team or group training cannot be made up for organizational reasons. According to § 615 BGB, our obligation to provide services no longer applies. The right to the training fee remains.If agreed training appointments for individual training cannot be kept, the customer must inform the tennis school immediately, but no later than 24 hours before the appointment. Lessons canceled in good time will be rescheduled. If the training appointment is not canceled in good time, our obligation to provide the service is void in accordance with Section 615 of the German Civil Code. The right to the training fee, including the pro rata hall rental fee in the winter season, remains. In the event of cancellation due to weather conditions, the training participant must pay half of the agreed fee.Training sessions that have to be canceled by the trainer will, if possible, be taken over by a substitute trainer or a catch-up date will be agreed. The tennis school will name several catch-up dates. If the customer is unable to attend the newly agreed dates, the tennis school is no longer obliged to provide the service and no reimbursement of the training costs will be made.

7. Exclusion from training

For disciplinary reasons, a training or course participant may be temporarily or permanently excluded from supervision. In this case, no refund will be made, nor will the participant be able to use the service offered for health or other reasons.

8. Duty of supervision for minors

The tennis school trainers’ duty of supervision for underage children is limited to the duration of the training session. Outside of training sessions, the tennis school trainers accept no liability. Parents and guardians must ensure that their children are continuously supervised before and after training sessions. They must instruct their children that they are not allowed to leave the training area and that they must follow the trainer’s instructions. The tennis school trainers accept no liability if a child leaves the training area.

9. Liability

The tennis school’s liability for damages of any child incurred in connection with the training is limited to cases of intent or gross negligence.

10. General validity rule

Should individual provisions of these terms and conditions of business and gaming be invalid or inapplicable in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid provisions, those provisions shall apply that come closest to the economic and legal purpose.

11. Data protection and use of images

We store your personal data electronically. Your data will not be passed on to third parties. After training has ended, we are entitled to store your data for a period of three years. The tennis school is entitled to use the players’ pictures, titles, media articles, successes, names, etc. without further consent or compensation.
