1. Inclusion of the General Terms and
Conditions The following conditions apply to all contracts concluded in connection with the tennis school PRO TENNIS PETRATSCHEK (hereinafter referred to as the tennis school). Subsidiary agreements, changes or additions must be made in writing.

2. Conclusion and duration of the contract
Submitting your registration represents an offer to the tennis school to conclude a service contract. The tennis school is free to accept the offer. The general terms and conditions are accepted when the contract is concluded. The contract is valid for the training period advertised and cannot be terminated early. In the event of early termination, the full invoice amount must be paid. Amounts already paid will not be refunded. The general terms and conditions of the tennis school and the court and hall regulations of the TC Rot-Blau Regensburg eV are binding for all training participants.

3. Training
Our range of services includes team, group and individual training. The tennis school’s trainers divide the groups according to practical requirements, in particular playing ability and age. The division can be changed if necessary.
The tennis school reserves the right to allocate the trainers. If this is necessary for organizational reasons, the tennis school is entitled to change trainers or give substitute lessons during the season.
The wishes of our customers are taken into account wherever possible. If courses are not fully booked, group changes may occur, which will require further agreement. Such a change does not constitute grounds for termination.
The tennis school is entitled to accept other course participants into a group on an individual basis for a “trial”. This requires prior agreement with the group participants. The changed costs for the lessons will be reimbursed by the new student to the original group participants.

4. Training
A training session lasts 30, 60, 90 or 120 minutes. The necessary court maintenance and warm-up also take place within this time. Training sessions may only be completed in sports clothing and tennis shoes. The tennis courts in the tennis halls may only be entered with footwear that is suitable for the indoor surface. Any illnesses or health restrictions must be expressly reported to the tennis school trainer before the training session begins. Sweets of any kind are prohibited during training. Glasses and non-sealable bottles are not permitted on the indoor court. The trainer’s instructions must be followed at all times.

5 a. Training costs
The training costs are paid by transferring the invoice sent to you, by direct debit or by purchasing in our online shop. The agreed total prices are always valid. This total price includes the sales tax valid at the time of the agreement and the training material.

5 b. Hall costs
For the use of the hall in connection with the tennis training at the tennis school, hall usage fees apply, which are invoiced by the tennis school.

6. Missed lessons
Lessons missed during team or group training cannot be made up for organizational reasons. According to Section 615 of the German Civil Code (BGB), our obligation to provide services does not apply. The right to the training fee remains.
If training appointments agreed during individual training cannot be kept, the customer must inform the tennis school immediately, but no later than 24 hours before the appointment. Lessons cancelled in good time will be made up. If the training appointment is not cancelled in good time, according to Section 615 of the German Civil Code (BGB), our obligation to provide services does not apply. The right to the training fee, including the pro-rata hall rental in the winter season, remains. In the event of cancellation due to weather conditions, the trainee must pay half of the agreed fee.
Training units that have to be cancelled by the trainer will be taken over by a substitute trainer if possible, or a catch-up date will be agreed. The tennis school will name several catch-up dates. If the customer is unable to attend the rescheduled appointments, the tennis school will no longer be obliged to provide the service and no refund of the training costs will be due.

7. Exclusion from training
For disciplinary reasons, a training or course participant can be excluded from supervision for a limited period or completely. No refund will be made in this case, nor if the participant is unable to use the service offered for health or other reasons.

8. Supervision of minors
The tennis school trainers’ duty of supervision for underage children is limited to the duration of the training session. The tennis school trainers accept no liability outside of training sessions. Parents and guardians must ensure that their child(ren) is continuously supervised before and after training sessions. Parents and guardians must inform their child(ren) that they are not allowed to leave the training area and that they must follow the trainer’s instructions. The tennis school trainers accept no liability if a child leaves the training area.

9. Liability
The tennis school’s liability for any damages you may incur in connection with training, regardless of their nature, is limited to cases of intent or gross negligence.

10. General rule of validity
Should individual provisions of the terms and conditions of business and gaming be legally invalid or not applicable, this does not affect the validity of the remaining provisions. Instead, the provisions that most closely achieve the intended legal and economic purpose shall apply.

11. Data protection and use of images
Your personal data is stored electronically by us. Your data will not be passed on to third parties. After training has ended, we are entitled to store your data for a period of three years. The tennis school is entitled to use the player’s images, titles, media articles, successes, names, etc. without further permission or compensation.
